Dog Training Service Agreement

Owner certifies that their dog has been fully vaccinated by their veterinarian.

 

SERVICES PROVIDED: Classes are taught by Elton Hill (“Trainer”), a professional dog trainer. Owners are limited to no more than ONE (1) dog so that personal attention may be given to each dog-handler team. No other pets or animals of any kind of Owner may be present during training. The trainer, at his sole discretion, may refuse entry to train or to continue the training of any dog that is not healthy, does not have current vaccinations, is aggressive, or in the sole discretion of Trainer does not seem suitable for the services to be provided.

 

PAYMENT: Full payment is due upfront. Payment is only accepted in cash, check, or a valid credit card. No refunds will be given after class has commenced.

 

REMOVAL FROM TRAINING: The Trainer, at his sole discretion, may remove a pet from class if a hazard or threat of any nature to any other animal or person is in the sole judgment and discretion of the Trainer is present. No refund will be given under such circumstances.

 

CLEANLINESS: The owner is responsible for the removal and cleaning of excrement that their pet is responsible for.

 

REQUIRED EQUIPMENT (to be supplied by pet Owner):

• Leash (4' to 6' made of leather, nylon, or rope, NON-RETRACTABLE)

• Properly fitting Collar and/or harness

• Treat pouchTreats (a variety of at least 100 pea-sized treats)

• Chew item or stuffed toy Items to clean up any of the Owner's dog excrement

 

Owner personally and for its heirs successors and assign hereby release and agree to hold Trainer harmless from, and against and waives for Owner and Owner's heirs, and any personal representatives any and all causes of action, claims, demands, damages, losses, attorneys fees, costs, expenses, judgments and compensation for damage or loss to myself and/or any pets or property that any act may cause, or failure to act of the Trainer, or that may otherwise arise in any way in connection with any services received from Trainer. I understand that this release discharges Trainer his heirs and assigns from any liability or claim that I, my heirs, or any personal representatives may have against the Trainer with respect to any bodily injury, illness, death, medical treatment, or property damage that may arise from, or in connection to, any services received from Trainer. This liability waiver and release extend to the Trainer together with all owners, partners, agents, and employees of the Trainer and others acting on behalf of the Trainer.

 

LIABILITY: If Dog causes property damage, or bites or injures any dog, animal, or person (including but not limited to Blue Rock Stables, Trainer, and Trainer’s agents and assistants), during or after the term of this Agreement, then the Owner agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Blue Rock Stables, Trainer and Trainer’s agents and assistants from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If the Dog is injured in a fight or in any other manner during or after the term of the Agreement, Owner assumes the risk and agrees that the Trainer should not be held responsible for any resulting injuries, losses, damages, costs, or expenses and agrees to hold Trainer harmless and indemnify Trainer for the same.

 

PET TECH FIRST AID AND SAFETY: The trainer is certified in pet first aid and safety by Pet Tech. The trainer will perform first aid on your dog as needed. The trainer will perform CPR on your dog for up to 15 minutes.

 

This Agreement is binding upon the Owner, spouse of the Owner, and Owner's heirs and assigns. This Agreement and all its terms supersede all prior discussions, representations, warranties, and agreements of the parties which may in any respects Inconsistent with this agreement and set forth the entire agreement between Owner and Trainer regarding the matters described above. The parties confirm that, except for that which is contained in this Agreement, no promises, representations, or oral understandings have been made about Dog Its training or any other matter. Without limiting the generality of the foregoing, the Owner acknowledges that the Trainer has not represented, promised, guaranteed, or warranted that the Dog will never bite, that the Dog will not be dangerous or vicious in the future, that the Dog will not exhibit other behavioral problems, or that the results of the training will last for any amount of time. This Agreement may be amended only by a written instrument signed by both Owner and Trainer.
